Last week, ICE issued Notices of Inspection to 500 business worldwide. This follows-up the 652 Notices of Inspection that went out in June 2009.

When a Notice of Inspection is issued, an employer has three business days to present all their I-9s for both active and terminated employees who fall within the I-9 retention requirements. They will generally also have to present payroll records to cover the retention period (three years). The government then takes possession of these records, audits them and issues their findings, which may include substantial monetary penalties for any violations found.
