h-1b approval secured for architectural intern

Wildes & Weinberg was recently successful in securing an H-1B approval for an Architectural Intern.

Immigration Services issued a Request For Evidence, requesting additional documentation and evidence to determine the applicant’s eligibility.
The Request for Evidence questioned whether Architectural Intern was a “specialty occupation” as defined in the H-1B regulations. We were successful in arguing that a bachelor’s degree is normally the minimum requirement for the particular position. We also argued that the degree requirement is common for the position in the industry of Architecture. 

We provided extensive documentary evidence to prove that the job of Architectural Intern is so complex that it can only be performed by someone with at least a bachelor’s degree in Architecture. Additionally, we proved that internship training is necessary before an individual can call himself an Architect.
