On Sept. 19, 2025, President Trump issued a proclamation restricting the entry of H-1B workers outside the U.S. unless they pay a new $100,000 fee. This takes effect Sept. 21, 2025, and lasts for 1 year (may be extended).
Key points:
• Appears to apply only to H-1B workers attempting to enter/reenter the U.S. after Sept 21. Current H-1Bs in the U.S. are largely unaffected unless they leave.
• USCIS will not process petitions for workers abroad without proof of the $100K fee.
• Extensions, changes of employer/status, and amended petitions inside the U.S. appear exempt.
• Exceptions may be made if DHS determines it’s in the national interest.
Practice Tip: H-1B workers abroad should enter the U.S. before Sept 21. H-1B workers should also avoid international travel until guidance is clarified.
This is a major change for employers and foreign workers—act quickly to minimize disruption.
