The EB-5 Immigrant Investor Program dates back to 1990, when the U.S. Congress created it as a route to lawful permanent residence for qualifying investors and their immediate family members.


Qualifying isn’t simply a matter of writing a check, though. In some situations, an investor has to put substantial capital into a new commercial enterprise, and that enterprise must create full-time jobs for U.S. workers. USCIS runs the program, while the SEC keeps an eye on regional center investments.


Two Primary Investment Pathways:

  • Direct Investment: Here, the investor either starts or buys a new commercial enterprise and takes a hands-on role in running it. The jobs that result from it must be direct, full-time positions filled by qualified U.S. workers.
  • Regional Center Investment: With this route, the investor channels capital through a USCIS-designated Regional Center. The big advantage is flexibility: both direct and indirect job creation count toward the requirement, and the investor doesn’t have to be involved in the day-to-day management at all.

Generally, yes. A qualifying EB-5 investment covers the investor’s spouse and all unmarried children under 21. Each qualifying family member receives conditional permanent residence through the investor’s petition and is included in the I-829 removal of conditions filing. Dependent family members do not need to make a separate investment.

Put simply, USCIS needs to see that every dollar of your investment capital came from a legal source. Conditional permanent residence lasts two years. In the 90-day stretch right before it expires, you’ll need to file Form I-829, the Petition by Investor to Remove Conditions on Permanent Resident Status. That filing has to prove two things: that the investment was made and kept in line with EB-5 requirements, and that the required number of qualifying jobs was either created or preserved. Once the I-829 is approved, you and your qualifying family members move on to unconditional permanent residence.

A word of caution here. Miss that filing window, or fall short of the evidence standard, and you risk losing your permanent residence status altogether. That’s exactly why preparing early and thoroughly matters so much.
