be prepared for an h-1b site visit!

Please be advised that in the past few months we have seen an unprecedented frequency of visits by Department of Homeland Security officials to the worksites of foreign workers sponsored by U.S. employers.

The primary focus of these visits is the employment of foreign nationals working in H-1B visa status.

Accordingly, we take this opportunity to remind you of the importance of ensuring that the employment of a foreign national in H-1B visa status conforms with the facts stated in the visa petition submitted to U.S. Citizenship & Immigration Services.

Employers are obligated to notify USCIS of any material change in H-1B employment (including but not limited to changes in job responsibilities, salary, location of employment, or shifts from full-time to part-time employment), and to maintain the Public Access File associated with the H-1B sponsorship in accordance with Labor Department regulations.

We recommend that you contact our office if you have any questions or concerns about the employment of H-1B workers in the United States.
