H-1B VISA (VISA FOR FOREIGN PROFESSIONALS WORKING IN THE U.S.) – NEW H-1B VISAS AND CONSULAR PROCESSING

  • All educational documents: photocopies of all degree and diploma certificates, transcripts (marks sheets) for each year of study, US or foreign (if foreign, need certified translation), copies of all other training, certification and educational documents;
  • Visa applicant’s (alien’s) detailed technical resume (C.V.), listing current and previous actual employers, not job sites or places of consulting, for resumes for Green Card purposes please see below;
  • Visa applicant’s current and all previous US visa documentation: photocopies of all previous US visa stamps, US CIS approval notices, current Form I-94, for foreign students also I-20s and EAD (Employment Authorization Documents), if any;
  • Copy of all pages of the foreign passport, especially ID pages, no need to copy and provide passport pages which are left blank;
  • Visa documentation regarding spouse and children (H-4), if any will be applied or if any are still abroad;

H-1B VISA TRANSFER (TRANSFER FROM ONE COMPANY TO ANOTHER IN THE U.S.)

  • In addition to all documents under 1), also need photocopies of last two paycheck stubs (paystubs) evidencing the alien’s continued employment by the previous H-1B visa sponsor (employer);
  • Verify visa status of all immediate family members (H-4 status ), need photocopies of documents, as listed under 1), verify status if in the United States, travel plans or any need for consular H-4 visa applications;

L-1 VISA & ALL EXTENSIONS (INTRACOMPANY-TRANSFEREE VISA)

  • All documents as listed under 1) for H-1B visa;
  • Detailed data regarding the alien’s present job title with the company overseas: detailed job description and salary with the company overseas and of his employment and career advancement with the company overseas, copy of the foreign organizational chart delineating the positions at company overseas, including the total number of associates working at the foreign location where the visa applicant is currently employed, and photocopies of the most recent paycheck stubs connecting the visa applicant to a specific company abroad which is a direct or indirect subsidiary of the parent company in the United States;
  • Documentation regarding the company and office in the U.S: detailed technical proposed job description in the United States, a copy of the U.S. company’s organizational chart, highlighting the proposed position in the U.S. organization’s staffing pattern, and the total number of associates at the site where the visa applicant will be located in the U.S, as well as the explanation for the need for transfer of specialized knowledge or a manager;
  • If alien is manager or executive (L-1A visa provide detailed explanation of the nature of managerial and executive duties, including the number and job titles of all subordinates; if alien is specialized knowledge professional (L-1B visa) please provide detailed explanation of the nature of specialized knowledge of company’s products, services, clients, markets, procedures, proprietary or licensed, confidential, unique products and services alien has a knowledge and experience with and gained while working for the company overseas and will transfer the knowledge, technologies and skills to the United States, currently not available in the local labor markets and please explain as to why not available in the local markets in the United States;

PERMANENT RESIDENCE (GREEN CARD) APPLICATIONS

  • In addition to all documents listed under 1) and 2) also need photocopies of the alien’s birth certificate, marriage certificate(s), divorce certificate(s), if any for all applicants;
  • Need list of previous actual employers, not places of consulting or job sites, including full addresses of previous employers, first and last name and phone number of previous supervisors (historical data only, it is acceptable if they are no longer there or all numbers are disconnected, etc);
  • Need employment reference letters stating job title, job duties and the exact period of employment, signed by immediate supervisor, if possible;
  • Photocopies of US Individual Tax Returns for last two years, bank and brokerage account statements, evidencing sufficient funds;
  • Photocopies of all pages of current passport for all applicants;
  • 6 recent photographs (immigration photographs) per applicant, information regarding immigration medical exam and adjustment of status or immigrant visa application forms will be provided later on.

IMPORTANT NOTE

While we will be pleased to assist regarding the visa status of your dependents (spouse and children), and provide all necessary consultations, etc, monitoring the expiration dates of their visas and entry documents, type of visas if changing status, etc, remains your primary responsibility.
